I considered this, but the problem is that it becomes even more difficult to enforce legal rosters. Instead of just checking whether teams have 25 actives we also have to check the schedule every time somebody is over the limit. Also, given that people already screw up their active roster on a regular basis (hence the need for enforcement) it's going to become an even more frequent issue if 26 active players are occasionally legal. The rule as proposed gives teams the basically the same flexibility as a 26 man roster without any difficulty added to the enforcement side.

It has the same effect on MIS play as the emergency injury transaction that is already allowed.
